June 14, 2024 Ethics Commission meeting:
The Oklahoma Ethics Commission approved a settlement agreement today in the matter of Case No. 2020-03, Make Oklahoma Great Again (“MOGA”), a Political Action Committee (“PAC”), and Jonathan Krems as Treasurer of MOGA. Within the terms of agreement, Krems agreed to pay civil penalties in the amount of $25,000 to the State’s General Revenue Fund for failing to register MOGA as an Oklahoma PAC in violation of Ethics Rule 2.80 and 2.98, as well as failure to file reports disclosing contributions and expenditures of the PAC and failing to file reports of Independent Expenditures (violations of Rules 2.2(7), 2.2(10), 2.79, 2.103, 2.100 and 2.105). Respondent Krems admitted responsibility within the terms of the Settlement Agreement for violation of these Rules as Treasurer of MOGA, and further agreed to receive education by the Oklahoma Ethics Commission prior to representation of any PAC in the future. PACs cannot circumvent Oklahoma reporting obligations even if already filing with the Federal Election Commission. Oklahomans look to the Oklahoma Ethics Commission and the Guardian System for transparency, and if PACs want to participate in Oklahoma elections, then Oklahoma campaign finance laws must be followed.
