Due to an INCREASE in the state average weekly wage, the maximum compensation benefit rate for injury, illness or death will change as follows:
- For temporary total disability, the maximum rate is $1,083.46 per week for injuries and illnesses arising during the period beginning January 1, 2025, and ending December 31, 2025. 85A O.S. § 45(A).
- For Permanent Total Disability (PTD) and Death, the maximum rate is $1,083.46 per week for work-related injury, illness or death occurring during the period beginning January 1, 2025, and ending December 31, 2025. 85A O.S. § 45(D) (regarding PTD), and 85A O.S. § 47 (regarding death benefits).
- For injuries occurring on or after July 1, 2021, the weekly rate will be $360 per week. See 85A O.S. § 45(C). For Permanent Partial Disability (PPD), the maximum compensation benefit rate remains unchanged at $350 per week for work-related injuries and illnesses occurring on May 28, 2019 through June 30, 2021.
